Terms of Service

1. Acceptance
These Terms of Service (“Terms”) govern your access to and use of BearingCore (the “Service”), operated by BearingCore. By accessing or using the Service you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization.
2. The Service
BearingCore is a CRM and workflow platform for industrial sales teams. Features include account, contact, visit, and lead management; AI-assisted coaching and document drafting; equipment cataloging and rebate program tracking; and, where enabled, utility incentive project workflow. Features available to your organization are set by your BearingCore account team.
3. Accounts
Access is provisioned by your organization’s administrator or the BearingCore platform team. You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify BearingCore immediately of any unauthorized use.
4. Acceptable use
You agree not to:
- use the Service to violate any law or third-party right;
- upload malicious code or attempt to compromise the Service or other customers’ data;
- scrape, mirror, or reverse-engineer the Service beyond what applicable law permits;
- share, resell, or otherwise make the Service available to anyone outside your organization without written consent.
5. Customer data
You retain all rights to the data you and your organization submit to the Service (“Customer Data”). You grant BearingCore a limited license to host, process, and display Customer Data solely to provide and improve the Service. BearingCore uses commercially reasonable safeguards to protect Customer Data and processes it in accordance with the BearingCore privacy practices then in effect.
6. AI assistance
The Service uses third-party large language models to produce summaries, drafts, and recommendations. Output is generated probabilistically and may contain inaccuracies. You are responsible for reviewing any AI-generated output before relying on it for a business decision. Do not paste sensitive personal information or regulated data into prompts unless your organization has specifically approved it.
7. Fees and subscription
Fees, billing cadence, and any pilot terms are governed by the order form or master service agreement between BearingCore and your organization. If no separate agreement exists, access is provided on a limited pilot basis at BearingCore’s discretion.
8. Termination
BearingCore may suspend or terminate access for material breach, non-payment, or use that threatens the Service or other customers. On termination, you may request an export of your Customer Data within 30 days, after which BearingCore may delete it.
9. Disclaimers
The Service is provided “as is” and “as available.” BearingCore disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by law, BearingCore’s aggregate liability arising out of or related to these Terms will not exceed the fees paid by your organization for the Service in the twelve months preceding the claim. BearingCore will not be liable for indirect, incidental, consequential, or punitive damages.
11. Changes to these Terms
BearingCore may update these Terms from time to time. Material changes will be posted here with an updated “Last updated” date. Continued use of the Service after the change constitutes acceptance of the updated Terms.
